S1246 – CRIMINAL PROCEDURE – Provides that the court is required to sequester a jury during deliberations in a first-degree murder cases only when the state has filed, and has not withdrawn, a notice of intent to seek the death penalty. (Defects bill.)
S1247 – CRIMINAL – Corrects an error in the wording of I.C. § 18-2406(3), pertaining to the provision that the defense to theft of a claim of right made in good faith does not excuse the retention of property of another to offset a demand held against the owner of the property. (Defects bill.)
S1248 – COURTS – Enacts a new statute clarifying that the Supreme Court may assign a senior justice, senior or active Court of Appeals judge, senior or active district judge, or a senior or active magistrate judge to sit with the Supreme Court when there is a vacancy on the Court, or when a justice cannot sit on the case because of disqualification, disability or absence. (Court bill.)
S1249 – WATER – Removes the Kootenai and Clark Fork Pend Oreille river basins from the Northern Idaho Water Rights Adjudication (NIA).
